Terms of Service

1. Basic definitions

Buyer — a natural or legal person intending to purchase goods on the Online Store website.

Registered buyer — a Buyer who has provided the Seller with personal information about themselves (surname, given name, patronymic, email address, telephone number) that can be reused when placing Orders. This information is provided when the Order is placed.

Seller — the organization that sells goods through the Online Store located at the address /.

Online Store — the website where any Buyer can review the Goods offered, their descriptions and prices, select a particular Item, a payment method and a delivery method, and place an Order.

Goods — the object of a sale, offered for sale in the Online Store by being listed in the corresponding section of the Online Store.

Order — a completed request from the Buyer to purchase the Goods selected in the Online Store and have them delivered to the specified address.

Article number — the designation of the Goods assigned by the Manufacturer.

2. General provisions

These terms of sale of goods in the Online Store (hereinafter the “Terms”) set out the procedure by which natural or legal persons, hereinafter referred to as the “Buyer”, purchase Goods through the Online Store; when mentioned together the Seller and the Buyer are also referred to as the “Parties”, and each individually as a “Party”.

Each Party guarantees to the other Party that it possesses the necessary legal capacity, as well as all rights and powers necessary and sufficient to conclude and perform the contract of sale.

By ordering Goods through the Online Store, the Buyer agrees to these Terms.

The Seller reserves the right to amend these Terms, and the Buyer therefore undertakes to check regularly for changes to the Terms published on the Online Store page.

The Buyer agrees to these Terms by ticking the corresponding box when placing the Order.

3. Registration in the Online Store

The Seller is not responsible for the accuracy or correctness of the information provided by the Buyer during registration.

A Buyer who registers in the Online Store receives individual identification by means of a login and a password. The Buyer's individual identification helps prevent unauthorized actions by third parties on the Buyer's behalf. The Buyer is prohibited from passing the login and password to third parties and is solely responsible for any adverse consequences that may result from doing so.

Personal information placed at the disposal of the Online Store during registration or by any other means will not be passed on to third-party organizations or persons without the users' permission, except where required by law or by a court decision.

4. Placing and fulfilling an order

When placing an Order, the Buyer confirms that they have read the rules for selling Goods through the Online Store and provides the Seller with the information necessary to process the Order.

The Seller prepares and ships the ordered Goods after receiving payment.

If the Buyer has questions about the properties and characteristics of an Item, the Buyer should contact the Seller using the Seller's contact details published on the Online Store website before placing the Order.

5. Payment for goods

Prices in the Online Store are stated per single unit of goods.

Only an Item shown as having a positive quantity in stock at the time of ordering can be ordered.

The Buyer pays for the Goods in the currency in which the price of the Goods was shown on the Online Store website at the time the order was placed.

The payer must be the Buyer themselves. Payments from third parties are not accepted. Payment is permitted only by one of the methods offered on the Online Store website when placing the order. Other payment methods are not available.

The contract of sale is considered concluded from the moment the Buyer pays for the ordered Goods.

6. Delivery

The Seller will make every effort to meet the delivery date and time specified in the relevant Order; however, delivery delays are possible due to unforeseen circumstances beyond the Seller's control.

The risk of accidental loss of or accidental damage to the Goods passes to the Buyer at the moment the Goods are handed over to them and the Buyer signs the documents confirming delivery of the Order.

To prevent fraud, the buyer must present an identity document when a prepaid Order is handed over.

7. Returns

Exchange and return of Goods is carried out in accordance with applicable law.

Whether an exchange or a return is possible is arranged by calling the telephone number published on the Online Store website.

8. Warranties and liability

The Seller is not liable for damage caused to the Buyer as a result of improper use of Goods purchased in the Online Store.

The Seller is not liable for the Buyer's losses arising from:

• incorrect provision of personal data,
• unlawful actions of third parties.

The Buyer bears full responsibility for the accuracy of the information they provide when registering in the Online Store.

The Parties are released from liability for full or partial non-performance of their obligations if such non-performance resulted from force majeure circumstances arising after the Terms took effect, caused by events of an extraordinary nature that the Parties could not have foreseen or prevented by reasonable measures.

In other cases of non-performance or improper performance of their obligations not provided for by these Terms, the Parties are liable in accordance with applicable law.

9. Confidentiality and protection of personal information

Provision of information by the Buyer.

When registering in the Online Store, the Buyer provides the following information about themselves: surname, given name, email address, telephone number. The list of data required to place an Order may be changed by the Seller unilaterally.

The Seller uses the information received from the Buyer:

• to register the Buyer in the Online Store;
• to fulfil its obligations to the Buyer;
• to evaluate and analyse the operation of the Online Store.

The Seller undertakes not to disclose the information received from the Buyer. The Seller's disclosure of information to agents and third parties acting under a contract with the Seller, for the purpose of performing its obligations to the Buyer, is not considered a breach. Disclosure of information in accordance with justified requirements of the law is likewise not considered a breach of obligations.

The Seller may use cookie technology. Cookies are service information sent by the web server to the user's computer for storage in the browser. This information is used to store data specific to that user and used by the web server for the correct operation of the Online Store. Cookies do not contain confidential information and are not passed to third parties.

The Seller obtains information about the IP address of the visitor to the Online Store. This information is not used to establish the visitor's identity.

The Seller is not responsible for information provided by the Buyer on the Site in a publicly accessible form, for example in product reviews.

10. Other conditions

The provisions of applicable law govern the relationship between the Buyer and the Seller.

The Buyer guarantees that all the provisions of these Terms are clear to them and that they accept them in full.

Should the Buyer have positive feedback or claims, they should contact the Seller at the email address specified on the Online Store website.

The Parties will attempt to resolve all disputes arising between them through negotiation. If no agreement can be reached, the dispute will be referred to a court in accordance with applicable law.

The invalidity of, or a Party's failure to comply with, any provision of these Terms does not render the remaining provisions of the Terms invalid.

If the Buyer does not agree with even a single provision of these Terms, they are not entitled to use the Online Store.
